Approved for Swedish F-tax (employer tax registration). Value Added Tax (VAT) is charged in accordance with applicable Swedish tax regulations.

2. Applicability

These terms and conditions apply between Åtorps Restaurang & Catering AB ("Åtorps", "we") and the client ("the customer") for all catering, food and beverage delivery, and related services. By placing an order — verbally, by telephone, e-mail, form, or any other channel — the customer accepts these terms. Any deviating terms submitted by the customer shall only apply if expressly accepted in writing by Åtorps.

3. Quotation and Order

  • A submitted quotation is valid for 30 days from the date of issue unless otherwise stated.
  • An order is binding once Åtorps has confirmed it in writing via e-mail or order confirmation.
  • The final number of portions must be communicated no later than 72 hours before the delivery date. Changes after this deadline cannot be guaranteed and may incur an additional charge.
  • Allergies and special dietary requirements must be stated at the time of ordering. We comply with EU Regulation 1169/2011 on the provision of food information to consumers.

4. Pricing

All prices are quoted exclusive of VAT unless otherwise clearly stated. A delivery charge applies as set out in the quotation. We reserve the right to adjust the price if raw material costs change materially between the date of quotation and delivery, always following prior notification to the customer.

5. Delivery

  • Delivery is made to the address specified by the customer within the agreed timeframe.
  • The customer is responsible for ensuring that a recipient is present at the agreed time.
  • In the event of non-receipt, the full cost of the ordered food and transportation will be charged.
  • Force majeure (weather, traffic, illness, government decisions, etc.) releases Åtorps from liability for delayed or failed delivery.

6. Cancellation and Rebooking

  • Cancellation at least 7 days before delivery: free of charge.
  • Cancellation 3–6 days before delivery: 50% of the order value will be charged.
  • Cancellation less than 72 hours before delivery: 100% of the order value will be charged.
  • Cancellation must be made in writing by e-mail to Catering@atorp.se.

7. Payment and Invoicing

  • Businesses, local authorities, and associations: payment against invoice with 20 days net from the invoice date.
  • Private individuals: advance payment or payment no later than the delivery date, unless otherwise agreed.
  • Invoices are sent primarily as e-invoices or PDF by e-mail. A paper invoice may incur a charge of SEK 50.
  • In the event of late payment, interest on arrears will be charged in accordance with the Swedish Interest Act (räntelagen) at 8% above the Riksbank reference rate, together with statutory reminder and debt collection fees.
  • Åtorps reserves the right to conduct credit checks on new business customers and to require advance payment for larger orders.

8. Complaints

Any defects or shortcomings in the delivery must be reported to Åtorps as soon as possible and no later than 24 hours after receipt, for reasons of food hygiene. Complaints should be directed to Catering@atorp.se or by telephone 073-620 72 74. Åtorps' liability is limited to the invoiced amount for the delivery in question.

9. Food Safety and Liability

Our business is registered with the environmental unit of Munkedal Municipality and we comply with the Swedish Food Act (livsmedelslagen, 2006:804) and EU hygiene regulations (852/2004 et al.). The food is intended to be consumed within the time windows and storage temperatures specified at delivery. Åtorps accepts no liability for damage arising from improper storage or handling after the delivery has been received.

10. Personal Data (GDPR)

We process personal data (name, contact details, order history) for the purpose of fulfilling the contract and complying with the requirements of the Swedish Bookkeeping Act (bokföringslagen). Legal basis: contract and legal obligation. Data is retained for as long as required under the Swedish Bookkeeping Act (7 years). You have the right to access, rectify, and — where there is no legal basis — erase your data. The data controller is Åtorps Restaurang & Catering AB. Contact: Catering@atorp.se.

11. Right of Withdrawal

Catering of food products is a service to which the right of withdrawal under the Swedish Distance Contracts Act (distansavtalslagen, 2005:59) does not apply, as food items are perishable goods manufactured to the customer's specification with a limited shelf life. Cancellations are handled in accordance with clause 6 above.

12. Disputes and Governing Law

These terms are governed by Swedish law. Disputes shall in the first instance be resolved by mutual agreement. If no agreement can be reached, the dispute shall be settled by a court of general jurisdiction, with Uddevalla District Court (Uddevalla tingsrätt) as the court of first instance. Consumers may also refer the matter to the Swedish National Board for Consumer Disputes (www.arn.se).
